Terms of Service — Estate Luma

These Terms govern your use of Estate Luma — the website at estateluma.io and the Workspace at app.estateluma.io (together, the “Service”). The Service is operated by Denis Saraseko, individual entrepreneur (Armenia, TIN 20437477, reg. No. 286.1618025) (“Estate Luma”, “we”, “us”). By creating an account or paying for a plan you agree to these Terms.

01The Service

Estate Luma is an AI-assisted marketing studio for real estate. You upload photos, plans, descriptions and documents for a property, and the Service produces marketing materials from them: edited and generated images, video transitions, property pages, presentations, social media creatives, texts, SEO copy, market analysis and a readiness audit.

We may change, add or remove features. If a change materially reduces what a paid plan includes during a period you have already paid for, you may ask for a pro-rata refund for that period.

02Accounts

A Workspace opens after you pay for a plan or make a Custom top-up; you then sign in with your email or your Google account. You must be at least 18 and able to enter a contract.
Keep your password confidential. You are responsible for activity in your account; tell us at once at estateluma.io@gmail.com if you suspect misuse.
An account belongs to one person or company and may not be shared with or resold to others.

03Plans, balance and payment

Payments in US dollars are processed by a third-party payment provider. The provider is named on the checkout page and on your receipt. Where it acts as our reseller and Merchant of Record, it is the seller of record for that order, handles payment, invoicing and taxes, and issues refunds under our Refund Policy.

Plans. Start, Pro and Agency are subscriptions for a 30-day period that renew automatically until cancelled. There is no free trial: using the Service starts with a payment.
Custom. A top-up of $25 or more opens 30 days of pay-as-you-go use without a plan. Everything — each property, build, analysis and assistant message — is paid from your balance at the price shown before you start. Each new top-up of $25 or more starts a new 30-day period.
What a plan includes. Each plan includes a number of properties and market analyses per period, plus a dollar balance. Everything else is paid from the balance at one price list, the same as on Custom. Limits reset at the start of each paid period; unused limits do not carry over.
Balance. Your Workspace shows a balance in US dollars. Everything not included in the plan is paid from it: building and rebuilding materials (landing page, Landing Pro, deck, social pack, video, SEO), the document check, new frames and upscales, video drafts and final renders, assistant messages, market analyses and properties beyond the plan. The price is shown before you start. The balance from a plan is valid for 60 days. Top-ups have no expiry date; on an active plan the minimum top-up is $10. The balance is prepaid credit for the Service: it has no cash value outside it and cannot be withdrawn or transferred.
When a period ends. If a plan or a Custom period ends and is not renewed, the Workspace is frozen: you can still view and download everything already built, but cannot create, build or generate. The remaining top-up balance is kept and becomes available again once you renew a plan or top up $25 or more.
You pay for results. When you start a build, its price is held on your balance and charged only when the build finishes. If it fails on our side, nothing is charged. For video, only the transitions that were actually rendered are charged.
Prices are shown on the pricing section. Taxes (VAT, sales tax) are added where required. We will give you at least 30 days’ notice before changing the price of an active subscription.
Cancelling. You can cancel at any time; the plan stays active until the end of the paid period. Refunds follow our Refund Policy.

04Your content

You keep all rights to what you upload (“Your Content”) and to the materials the Service generates for you (“Outputs”), to the extent rights can exist in them.

You give us a limited licence to store, process and transform Your Content only to run the Service for you — including sending it to the AI providers listed in our Privacy Policy. We do not use Your Content to train models and do not publish it. We may show an Output in our portfolio only with your written permission.

You confirm that you have the right to upload Your Content — photos, plans, documents and any personal data in them — and to use it for marketing the property.

05AI outputs

Outputs are created with machine-learning models and may contain errors. Generated images can differ from reality — for example a different time of day, light, season or staging. Before publishing, you are responsible for checking that materials are accurate and are not misleading to buyers, and for meeting the advertising rules of your market.

The readiness audit and the Documents tab check completeness and consistency of the files you provide. They are not legal advice and not a title or due-diligence report.

06Acceptable use

You may not use the Service to:

market a property you are not authorised to market, or present generated images as unedited photographs where the law or the listing platform forbids it;
upload content that infringes someone’s rights, is unlawful, or contains other people’s personal data without a lawful basis;
reverse-engineer the Service, scrape it, bypass limits or share an account to avoid buying seats;
generate or attempt to generate sexual, violent, hateful or illegal content, any content involving minors in a harmful way, or images of identifiable real people;
overload the Service or test its security without our written consent.

Every uploaded image, written instruction and generated result is checked by automated content moderation. If the check fails or cannot be completed, nothing is generated and no credits are charged. After three blocked requests within 30 days the account is suspended until we review it manually.

We may suspend an account that breaches these rules. Where possible we will warn you first and let you export your materials.

07Our property

The Service, its software, design, templates and the Estate Luma brand belong to us. These Terms do not give you any rights to them except to use the Service as described.

08Third-party services

The Service relies on third-party providers for AI processing, hosting, maps and payments. Their availability is outside our control; we choose them carefully and will tell you about material changes in the Privacy Policy.

09Warranty and liability

We provide the Service with reasonable skill and care, but “as is”, without a guarantee that it will be uninterrupted or error-free or that materials will lead to a sale.

To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect losses such as lost profits or lost deals. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

10Ending the contract

You can close your account at any time by writing to us. We may end the Service for you with 30 days’ notice, or immediately for a serious breach. After closure we keep your data for up to 30 days so you can export it, then delete it, except where we must keep payment records by law.

11Changes and governing law

We may update these Terms. For material changes we will notify you by email or in the Workspace at least 14 days in advance; continuing to use the Service after that means you accept them. These Terms are governed by the laws of the Republic of Armenia, without prejudice to mandatory consumer protection rules of your country of residence.
